Terms of Service

By accessing or using any PCB Cupid service — including Circuit Spell, the open-source module library, the e-commerce shop, or the community forum (collectively, the “Services”) — you agree to be bound by these Terms of Service (“Terms”). If you are using the Services on behalf of an organisation, you represent that you have authority to bind that organisation.

You must be at least 16 years old to create an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorised access.

By using PCB Cupid services, you agree to use them responsibly and in accordance with applicable laws and industry standards. You specifically agree not to:

• Prohibited Content: Use services to create or share designs for illegal, harmful, or malicious purposes, including weapons, explosives, or devices that violate safety regulations or intellectual property rights.
• Intellectual Property: Upload or share content that infringes patents, copyrights, trademarks, or trade secrets of third parties. Respect the intellectual property rights of others and only share content you have rights to use.
• System Abuse: Attempt to reverse-engineer, decompile, or extract source code or AI models; circumvent rate limits or access controls; use automated scripts to scrape data or overwhelm our systems.
• Fraud and Security: Provide false information, use stolen payment methods, attempt payment fraud, or exploit vulnerabilities in our systems or third-party integrations.
• Commercial Exploitation: Resell or sublicense Circuit Spell access without explicit enterprise agreement; use free-tier for commercial purposes beyond specified limits; create competing services using our technology or data.
• Community Standards: Harass, abuse, or threaten other users; spam or send unsolicited commercial messages; violate community guidelines in forums or collaborative features.

Hardware Design Ethics: When creating PCB designs, consider safety, reliability, and environmental impact. Do not design devices that could cause harm, violate regulations, or be used for malicious purposes. PCB Cupid reserves the right to remove content that violates these standards.

License and Usage Rights: Hardware module designs published in our open-source library are released under the CERN Open Hardware Licence v2 – Permissive (CERN-OHL-P). This license allows you to:

• Use, modify, and adapt the designs for any purpose
• Manufacture and sell products based on these designs
• Distribute and share the designs and documentation
• Create derivative works and improvements

Responsibilities and Limitations:

• You must include the original license and attribution when sharing designs
• PCB Cupid makes no warranties regarding fitness for any particular application
• You are responsible for validating designs before use in safety-critical or regulated products
• Always independently test and verify designs, especially for medical, automotive, or aerospace applications
• Comply with all applicable regulations and industry standards in your jurisdiction

Community Contributions: When you contribute designs to our open-source library, you grant other users the same rights under CERN-OHL-P. You retain copyright to your original contributions while allowing the community to benefit from and build upon your work.

Pricing and Billing: All prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless otherwise specified. International customers may be charged in their local currency at current exchange rates.

Circuit Spell Subscriptions: Paid plans are billed in advance on monthly or annual cycles. Subscription automatically renews unless cancelled at least 24 hours before renewal date. Upgrades take effect immediately; downgrades take effect at next billing cycle.

E-commerce Orders: Physical products are charged at time of order placement. Payment is processed securely through Razorpay. We accept credit/debit cards, UPI, net banking, and other payment methods available in your region.

Refund Policy:

• Digital Services: Circuit Spell subscriptions may be cancelled anytime. Refunds for unused portions of monthly subscriptions are not provided, except where required by law. Annual subscriptions may be eligible for pro-rated refund within 14 days of purchase.
• Physical Products: Items may be returned within 14 days of delivery if unused and in original packaging. Customer is responsible for return shipping costs. Refunds are processed within 7 business days of receiving the returned item.
• Manufacturing Defects: Products with manufacturing defects are eligible for replacement or full refund within 6 months of purchase. Contact us at [email protected]for warranty claims.
• Digital Downloads: Design files and software downloads are non-refundable once accessed, except in cases of technical issues preventing access.

Payment Disputes: For payment-related issues, contact your bank first, then reach out to our support team. We will cooperate fully with payment processors to resolve legitimate disputes.

PCB Cupid Ownership: PCB Cupid retains all intellectual property rights to the Circuit Spell software platform, AI models, user interface, brand identity, documentation, and proprietary technologies. This includes but is not limited to source code, algorithms, training data, and system architecture.

Your Design Ownership: You retain full ownership and intellectual property rights to all PCB designs, schematics, layouts, and other content you create using Circuit Spell. Your designs are your property and you are free to use them for any purpose, commercial or otherwise.

Limited License Grant: By using our services, you grant PCB Cupid a limited, non-exclusive, worldwide license to:

• Store and process your designs solely to provide the service to you
• Analyze anonymized usage patterns to improve our AI models and features
• Display your designs in your private account workspace
• Provide technical support and troubleshooting assistance

No Commercial Use of Your Content: We do not use your designs for commercial purposes, sell them to third parties, or include them in our marketing materials without your explicit permission. We do not claim ownership of your intellectual property.

Third-Party Content: Some components, libraries, or design elements may be provided by third parties. You must respect their respective licenses and terms when using these elements in your designs.

Service As-Is: PCB Cupid services are provided "AS IS" without warranties of any kind, whether express or implied. We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.

AI-Generated Design Limitations: Circuit Spell provides AI-assisted design suggestions and recommendations. These are not certified engineering solutions and may contain errors, omissions, or design flaws. You are solely responsible for:

• Validating all designs before manufacturing or deployment
• Ensuring compliance with safety regulations and industry standards
• Testing prototypes thoroughly before production use
• Verifying component specifications and compatibility
• Conducting independent engineering review when required

Physical Products: While we strive for high quality, we do not warrant that physical products will be error-free or meet your specific requirements. Products are provided subject to the manufacturer's warranty terms where applicable.

Service Availability: We do not guarantee uninterrupted or error-free service operation. Maintenance, updates, or technical issues may cause temporary service disruptions.

Maximum Liability: To the maximum extent permitted by applicable law, PCB Cupid's total liability for any claim arising from or related to our services shall not exceed the greater of: (A) the amount you paid to PCB Cupid in the 12 months preceding the claim, or (B) USD 100.

Excluded Damages: In no event shall PCB Cupid be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Lost profits, revenue, data, or business opportunities
• Damage to your computer systems, data, or other property
• Claims arising from your use of AI-generated designs in products
• Third-party service interruptions or data breaches

Hardware Design Risks: You acknowledge that PCB design and manufacturing involves inherent risks. PCB Cupid is not liable for damages resulting from:

• Manufacturing defects in products based on our design suggestions
• Component failures or compatibility issues
• Non-compliance with safety or regulatory standards
• Financial losses from failed prototypes or production runs

Indemnification: You agree to indemnify and hold PCB Cupid harmless from any claims arising from your violation of these terms, your use of our services, or your infringement of third-party rights.

We may revise these Terms at any time. Material changes will be communicated via email or an in-app notice at least 14 days before taking effect. Continued use of the Services after the effective date constitutes acceptance of the revised Terms.

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka, India.
